In 1973 I resigned from my job at Kashmir Govt Arts Emporium (A unit of J&K Handicrafts S&E Corporation) and went to Delhi to look out for a job. I was 23 years old, armed with MSc (Botany) and B Ed degrees from Kashmir University. An interview call had been received from Apeejay Public School, Faridabad. As I entered the room and was seated in front of the interview board, one of the interviewers said, " You are from Kashmir University, isn't it?"
"Yes Sir", was my answer.
"Oh, that University....! It reminds me of a bad experience I had with them. Once they sent me MA (Political Science) answer books for evaluation. After 2 months I received a reminder to send the evaluation sheets and answer books as it was too late. I replied that first you send me the honorarium due to me then only shall I send the result sheets otherwise not. In fact, I learned that they always delay in paying the honorarium and one has to remind them several times before money is received. The correspondence went on for another month or so. Then they informed me that I need not send the result sheets as they have already announced the result on the basis of the average of other subjects. That was enough to shock me."
It looked like I had started on the wrong foot. A very bad picture had been painted by him on the minds of the interview board. So I had not only to prove my mettle but also to remove the negative image from their minds. I humbly replied, "Sir, have you come here to evaluate my university or me. You ask me relevant questions and I shall try to answer."
Other members agreed with me and after that, the expert on Biology asked me several questions which I answered to the best of my ability.
At the end, I asked, "Sir, how did I fare, will I be selected?"
"That we can't tell you now, there are thirteen candidates in your category, you are seventh and six are yet to be interviewed."
"Okay Sir, I shall wait outside till all of them are interviewed because I cannot afford to go to Srinagar and come back if selected that too when no TA/DA is permissible."
"Okay wait outside, we will see," The Chairman said.
After they finished with the other candidates, I again approached them and asked for the result. The Chairman said, "It is not possible to inform you right now unless the result is approved by the Competent Authority."
"But Sir, you have already decided the Competent Authority has simply to endorse it. You should be able to let me know."
"No, no, that is not permitted by the rules."
"Sir, I waited this long only to tell you that all institutions go by Rule Book. Nobody can short-circuit them. Isn't it? My Kashmir University also has laid down certain rules about evaluation and payment to evaluators, and nobody can force them to change the rules. Anyway, I am aware you won't be able to tell me the result now due to bureaucratic red tape. So be it. Anyway, I am going back."
After a few days, I received a postcard for joining the job but I declined with the following reply sent on a postcard.
"My offer was rejected on the spot. Since no TA/DA is given, I can only afford to travel on my own once. Thanks."
Incidentally those days there were no walk-in interviews

I thought of relating an experience of the maiden interview I had to face in 1971. I completed my MSc (Botany) & B Ed in 1971 at the age of 21. I used to teach the children of the MD of J&K Handicrafts Corporation without any remuneration due to the insistence of my late father who was working in the organization and inching towards retirement. My father was very hardworking and honest but had faced many problems in the office during his short career. He was keen to get an extension due to liabilities at home. The MD too had a reputation of honesty and he was happy with the work of my father.
My father had joined the organization in 1961 after giving up two well-located handicraft shops, one on the Bund & another in the Central Market, on the insistence of my late mother. He was appointed as Manager initially but after some time was told that his appointment was only that of Asstt Manager. Being naive to Bureaucratic bungling, he resented and accepted just ₹200/- pm as pay till his case was settled. Even as Asstt Manager he would otherwise be entitled to ₹250+ pm. The case took more than 10 years to be decided in his favor but no arrears were paid to him. With this meager sum the widower looked after one son and three daughters.
The organization opened its gates to new blood for the first time as the MD invited applications for jobs of Managers/Asstt Managers. MD instructed my father to tell me to apply for the job. I refused straight away explaining that I want to join the Education Department and am qualified for the same. Father talked to my uncle who had a great influence on me, he painstakingly explained to me the situation of the household and convinced me to send my application.
A written examination was held in which I stood 3rd in the list. One Abdul Samad (MA Eco) was placed first and Ms Madan, daughter of the Secretary of the organization was placed second.
Then came the Oral interview in which there were three members, one was the MD himself, another was Mr Tambe, MD JK Industries, and third I didn't find out who he was. Mr Tambe, IAS had earlier worked as Commissioner, forest department for some time. So he shot out questions about plants and vegetation.
"What do you know about the vegetation of the temperate region?" I explained what the characteristics of the temperate region are compared to Tropical and Sub-Tropical regions but simultaneously told him that it is not humanly possible to give the names of all plants in the temperate regions. He realized that and therefore, shot another question, "What is an exotic?" I correctly described what exotic means. He asked me to give an example, possibly had Chinar in mind. I was nervous, couldn't remember any, but since I was working on root ecology of a plant I thought how much botany might this fellow be knowing. So I replied, "Sir, Salvia moorcroftiana." He looked at me bewildered but immediately added, "How about Chinar?" I was not aware of its origin so said confidently, "Oh Sir, Platanus orientalis". He shot another question, "Where did it come from?" I almost got frustrated but held on my nerves, "Sir there are several views about its origin. Some say it is indigenous, some say it came from China ( I thought Chinar word has China in it ), and some say it came from the Middle East." So left no options. MD felt that I was replying well so he told Mr Tambe, "Ask him more if you please." I was on the verge of breaking down. But thank God they told me it is all over, I could go.
The result was announced after some days. A few candidates, even those who were far below me in the merit list, were appointed as Managers (The Secy's daughter declined the offer) while I was offered Asstt Managers post in the pay scale of ₹140-250. The list had its communal markings on it. Was Shocked, so I didn't want to join but again under the pressure of my uncle and father had to join my first posting as Asstt Manager, Kashmir Govt Arts Emporium, Chandigarh on 01 April 1971

In its latest decision the Central Government has decided to retire all such Officers of Indian Civil Services viz IAS, IFS, IPS, IAAS, IRS, IRaS, IPoS, IIS etc who are found inefficient upon review after 15 and 25 years of service. They will however be entitled to pension as earned by them on such date. The exercise is aimed at increasing efficiency in the bureaucracy besides bringing down corruption in the administration.
Previously officers were permitted to seek voluntary retirement with a similar view to weed out the dead wood but the scheme proved counter productive as it was the efficient officers who sought retirement because they got better offers from the private sector companies while dishonest and inefficient officers stayed put.
In order to understand the implications of the present scheme we have to analyse as to how the Indian bureaucracy absorbs and develops new talent and functions in our democratic set up. Traditionally, in our society first preference is given to medicine and engineering degrees for which one has to qualify pre-medical or pre-engineering examinations with very high merit. Whoever are left, try to obtain graduation degrees in various disciplines and some of them appear in Indian Civil Service examination. However in the case of children of  Government Officers who taste perks of bureaucracy early in their life, the career charting is different. Most of them are groomed for the civil services from childhood itself. Consequently, the bureaucracy turns out to be a jugglery of mediocrity who pose as know-alls in all fields, fill positions from District Collectors to Secretaries, go on deputations to Public enterprises and manage PSUs as diverse as Steel giants, textile manufacturers, drug companies and fertiliser corporations. Nevertheless, with liberalisation of economy the scenario has changed and bright people now look towards multinational corporations for better career prospects. On the contrary the civil services have started attracting maladjusted engineers and doctors of late. But then India is a country of 120 crores and therefore despite this change of preference long queues can still be noticed for getting into Indian Civil Services. As already mentioned the children of erstwhile bureaucrats continue to prefer the Services while the Politicians tactically prefer matrimonial alliances of their children with such officers who would help them in the long run. It can be seen that most of these officers come from particular colleges and from specific locations like Delhi, Allahabad etc. The alumni of these colleges help each other in networking, lucrative postings, deputations, foreign assignments and even promotions.
It is no secret that most of the bureaucracy in India is corrupt. A few who are exceptions only prove the rule. One may recall the in-house voting conducted by UP bureaucrats some years ago to find out the most corrupt officers in the cadre. The results were startling. The bureaucracy has inherited corruption from their forerunners in the British establishment but it received a new impetus from the socio-political set up of the country. The politicians and bureaucrats form a vicious circle, one promotes the other. The bureaucrats who help politicians to achieve their nefarious objectives subsequently get party tickets for elections and become ministers after their retirement. Under these circumstances the bureaucrats lose no time to implement illegal orders of their political bosses and fill their coffers both in India and abroad.
With the implementation of the announced scheme, it needs to be noted that evaluation of Officers after completion of 15 or 25 years of service will entirely depend upon the performance appraisals of such officers recorded year after year. Who will write these Annual Confidential Reports (ACRs)? They will either be written by their political bosses if the officers are senior enough or by such superior officers whose bridle will be in the hands of politicians. Both of them will be prejudiced against honest and conscientious officers. Given the fact that honesty is inversely proportional to efficiency in a country like India, this too will work as a handicap against the honest officers while the dishonest and smart officers will have smooth ride throughout their career.
The performance of officers also depends upon the places they work, the environment they are set in and the prevailing work culture. The officers with better network and effective godfathers have no difficulty in getting postings of their choice at places where they do not face any problems whatsoever. They enjoy their postings as also manage excellent ACRs while their counterparts work under adverse conditions and face militants, naxals, labour unions or political hooligans and resultantly are not able to show as good tangible results. I remember the case of an officer who was brought on deputation to Delhi, his home town, from a militancy infested state to become a member of the team set up for organising an international exhibition while his counterpart in the militancy infested state was asked to look after double charge i.e his own job as also the job of the deputationist. The officer on deputation worked in his home town, his children continued to receive education in Delhi's elite school, he expanded his network by including more politicians in it, got an outstanding ACR, received an award and managed his posting to Delhi after the end of the exhibition while the period of exhibition was shown as having worked in  the militancy infested state. The other officer whose life was in danger could only get an average ACR because none of his bosses ever visited the state during the period where they could have appreciated the good work he had done. Such are the ways of bureaucracy!
The most important tool for evaluation of work of officers is through targets assigned to them, both quantitative and qualitative, and achievements against them. While it may be easy to fix targets for the officers in the field, it is not so easy to fix targets for those officers who work in the Ministries and Secretariats and deal with files only without getting exposed to practical difficulties. Even if such targets are fixed arbitrarily they remain only an eye wash and therefore are prone to the subjective evaluation of their bosses. Such officers have a definite edge over the former and therefore secretarial jobs provide a shelter for the blue eyed boys who manage postings in such places.
The proposed system will work against the interests of the officers belonging to reserved categories such as scheduled castes, scheduled tribes, other backward classes and minorities who do not have many godfathers in higher echelons of bureaucracy. Given the fact that they are admitted to Civil Services with lower merit, they are not expected to be as intelligent as their higher caste colleagues and produce similar results. Therefore, their weeding out will be facilitated surreptitiously. Even today if seniority lists are analysed thoroughly it will be noticed that the percentage of officers belonging to these categories dwindles gradually as they go up the ladder in their career and may be negligible at the end of the road due to the subjectivity and prejudice. Many officers of lower castes are stiffled and stunted enroute during their journey towards superannuation. The proposed scheme will further put hurdles in their path of progress.
Last but not the least it may be seen how sincere the government is for ensuring efficiency of the bureaucracy at present. There are innumerable complaints which have not been even acknowledged not to speak of taken up for investigations. The cases whichever taken up for investigations are not completed for number of years wilfully so that the officers quietly superannuate. Wherever cases are investigated the agencies ensure that these remain week with loopholes in evidence so that these fall by wayside during trial. It would be high time to investigate the mortality percentage of cases handled by the investigating and vigilance agencies of the central and state governments to see how efficient these agencies are. Let us hope the government does not make laws that make cure worse than the disease.

I was in anguish when I saw the face of Anna Hazare on TV during his fast in Mumbai. He was adamant to carry out his fast despite running high temperature and he tried his best to keep his promise to the nation.. This frail old man of 74 has personally nothing to gain out of this struggle but wants to see Rama Rajya established in Bharat. I have purposely used the words 'Rama Rajya' and 'Bharat' because they are drawn from our ancient culture and not imported. However, let me make it clear that I have not been advised by any party or social group to use these words. Nor has Anna Hazare been advised by any party or social group to undertake a crusade against corruption. Had it been so, the Shiv Sena supremo would not have expressed his dislike for him.
Mumbaiites failed this selfless soul for reasons best known to them. Reasons can be many. One, Mumbai people are time conscious and do not have time to spend for political rallies since time has a cost for them and they attend the rallies of Politicians only because they are paid for the same. Two, proper logistics was not planned by IAC to ensure proper attendance coupled with State Government sabotaging it by creating transportation hurdles. Three, people found no reason why Anna should undertake fast when the bill was being tabled in the Lok Sabha. Whatever reason may have weighed heavily on the minds of the people, fact remains we failed this sincere crusader against corruption. I refrain to call Anna a Mahatma or a Second Gandhi because such tags raise the expectations of the people from the mortal human beings.
During the past several months the Government used many a method to bring down the image of Anna and his team. Initially they questioned their integrity and their past record. I do not know how much truth is there in such allegations but question arises as to why did the Government not take action against them at proper time and preferred to undertake a smear campaign now. Fortunately,this adverse publicity did not find favour with the public. I would like to add here that no body in this world is perfect and there is a possibility of some mistake having been committed by any one of them. What has to be seen is whether the act committed was with an intention to amass wealth and become rich or was it a mere act of oversight? I would advise all the members of IAC to declare their assets and let any one conduct scrutiny as they please.
When the Government failed to smear the good name of  IAC activists, it resorted to communalising the whole issue through their hounds who day in and day out publicized that the movement had the backing of RSS. For the sake of discussion, let us presume that the movement has a backing of RSS, what then? Is fighting against corruption an anti-Muslim act or anti-Christian act? Does rooting out corruption adversely affect the rights of Scheduled castes, Scheduled tribes and Other backward Classes? Muslims are known to have least representation in Government jobs. Would anti-corruption measures not reduce nepotism, communalism and money power in recruitment and ensure that all deserving Muslims get their due? Would machinations of high-caste babus not be exposed if Lokpal bill was in place? Would we not get a society which believed in equality of opportunity? If RSS backs a movement which benefits all the citizens of the country should we oppose it just because a Hindu body supports it. I feel we should welcome any step taken by anybody if it is for the welfare of the entire society and not for a few. In fact it is today I wish that Muslims and Dalits had sincere and selfless leaders like Maulana Abulkalam Azad and Baba Saheb Ambedkar who would have shown them the right path.
An objection was raised whether a nominated body could take to task the Prime Minister or the elected representatives of the people who indulge in corruption? The answer is make the Lokpal also an elected body. Let the Lok Sabha and Rajya Sabha elect the members of Lokpal. Even by selecting the members of Lokpal through PM, Vice President, Speaker,Chief Justce and an eminent Jurist , he becomes indirectly elected as majority of the selectors are elected representatives of the people. The only thing an independent Lokpal ensures is that it will focus on eradicating corruption from the country and would expedite such cases.
And then the big questions that Prime Minister will be belittled if he comes under the purview of Lokpal. May I ask a counter question as to why should a Prime Minister do an act which calls attention of a Lokpal?  If he is upright , every citizen of India including the Lokpal will bow before him and he will write his name in golden letters in the history of India.
Last but not the least , I feel that there is still time for the Parliamentarians to rise above party politics and petty personal gains and give to the people of India a Lokpal which is truly an independent body so that the generations to come will remember them the way they remember B R Ambedkar and the constitution makers.

Having studied different points of view put forth by different groups regarding the Lok Pal, his appointment, jurisdiction and the organisational structure, I have come to the conclusion that all of us are not sincerely attempting to achieve the sole objective to root out corruption from this country. I have been witness to the functioning of bureaucracy in this country all my life and my feeling is that the bureaucrats behave more like Masters of the people rather than Public Servants. Needy people have to run from pillar to post to get even ordinary jobs done like driving licenses, passports, hard earned pensions /gratuity/ provident fund  and even withdrawing the money their deceased parents have deposited in Post offices not to speak of appointments, contracts, tenders and the rest. The environment has become so pessimistic and suffocating that there does not seem to be any escape route. Thanks Anna Hazare, the Crusader against corruption, that some light is now noticed at the end of the dark tunnel.

Lokpal vs 120 crores One question that has continuously been raised is how can single Lokpal attend to the grievances of the 120 crore people of India.(though this number does not take into consideration that most of the grievances arise from house-holds represented by the head of the familiy which brings down the effective number to only 20 crores). Hopefully children under the age of 18 do not need the help of Lokpal. Not only this, every one in India is not affected all the time by Central Government working and most of the corruption is noticed in the State government Departments for wihch seperate Lok Ayuktas have to be appointed with their own organisations assisting them. Moreover, with the help of computers and internet many things can be achieved in no time which were unthinkable in olden days.

CBI AND CVC Appointment of Lokpal  will render CVC almost redundant while the continued functioning of CBI under the government under the pretext of so called independence will leave it toothless. Strong IAS/IPS lobby will not like any change in both CVC and CBI where their career is assured but we have to swallow the bitter pill. All the government employees have to be brought under the net of one agency called Lokpal, otherwise cases where Officials of different cadres are involved will be tossed between these different agencies causing undue delay. In the event Gp C and Gp D posts are kept under CVC which remains under Government as hitherto before, the situation will remain unchanged since the percentage of Gp C and D employees form the bulk of Government Servants and their exclusion from Lokpal will defeat the very purpose for which Lokpal is sought to be made. Needless to mention that most of the corruption is indulged in and routed through GpC and Gp D who act as conduits for their bosses except in very large contract deals. The public in India are directly affected by the corrupt practices of theses Gp C and Gp D employees in their day to day dealings. It is therefore important that all employees are brought under the ambit of Lokpal and the Lokpal is provided with its own investigative agency or CBI is directly placed under it. The head of the CBI should be appointed by PM, Lokpal and Chief Justice of Supreme court. Similarly the CVC should either be disbanded completely or else brought under the ambit of Lokpal as its aministrative wing, as against investigative wing(CBI), and its responsibility will be to receive public grievances and their redressal besides Legal matters concerning Lokpal. Appointment of CVC will be the same way as in the case of Head of the CBI.

Citizen's Charter Citizen Charter  has to be prepared by the respective Ministeries, Departments and Government Offices. Lokpal is only required to effectively monitor its implementation which will not put any substantial burden on the Lokpal in any way.

Appointment Appointment of Lokpal should be for a fixed tenure of 5 years and his selection should be done on  a broader basis. Prime Minister, Leader of the Opposition, and Chief Justice of India should form the selection panel which will ensure greater weightage to the elected representatives as against the Technical expertise.
Prosecution powers The Lokpal will only be effective in case it can take up complaints independently and investigate all the complaints received against any Government servant without any interference from any quarter and in case any of the allegations is prima face established, further prosecute the said Government servant. In absence of any such powers of prosecution and non-availability of organisation for such prosecution , Lokpal will be rendered into a white elephant and will dismay the public who have entrusted it with their dreams.                                                             I only wish good sense prevails upon all the political parties to see the virtue behind the bill which is expected to help the nation progress rather than cling on to their vested interests for I am sure today they may escape but future generations will not spare them.

Dear Shri Bhushan,

At the very outset let me introduce myself. I am neither a rightist nor a leftist, nor even a centrist. I am just one out of one hundred and twenty crores of Indians, and I belong to Kashmir. I am the original inhabitant of Kashmir with history dating back to five thousand years which is older than Judaism, Christianity and Islam. Over a period of last seven centuries I have been reduced to a minuscule minority of not more than five lakh souls due to repeated invasions, proselytizing and persecution. However, I rejoiced the day my country was declared independent in 1947 though I remained in a state of fix because my brothers and sisters in Baramulla were facing genocide and rapine till such time Maharaja of Jammu and Kashmir finally decided to accede to India. From that day onwards I preferred to exist without complaint in a state of continuous deprivation and denial.The only solace for me was that I lived in my own homeland and country.

But your recent statement pained me immensely. I had heard similar things earlier from a few more self styled activists like Arundathi Roy who has taken upon herself the burden of the nation just because she has written a book in English which has won her acclaim.Had she written the same in any other language she would not be known even beyond her street for you know the fate of other writers in India. Incidentally I have written seven books in Urdu till date. Your statement came as a bolt from the blue because I had pinned many a hope upon the Anna team since I regard Anna as the saviour of the  country in modern times.

May I again emphasise that I am the original inhabitant of Kashmir which has a hindu tradition of five thousand years. Not only that, Jammu and Kashmir is not inhabited by only Kashmiri Muslims but by Dogras, Sikhs, Budhists and Christians as well. Even among Kashmiri Muslims there are differnt sects and schisms such as sunnis and shias, gujjars, Kargil and Ladakh muslims who do not see eye to eye with each other. When you talk of Plebiscite as the ultimate resolution of Kashmir problem you seem to ignore these facts.The Plebiscite carries certain obligations on the part of all the parties involved viz India, Pakistan and the State of Jammu and Kashmir. You may be aware of Pakistan having annexed parts of erstwhile J&K State like Gilgit, Skardu, Hunza, Nagar and Baltistan with mainland Pakistan and having ceded a part of the state to China for strategic purposes to encircle India. Whatever was left was assigned the nomenclature of Azad Kashmir by Pakistan which ironically never enjoyed freedom and democracy in the past six decades as opposed to the Jammu and Kashmir State, a part of India, where liberty, equality and freedom of worship is enjoyed by all the citizens. The original idea of plebiscite was that it was required to be undertaken on return of normalcy in in whole of J&K state without any attempt of ethnic cleansing in any part. Is this practicable now when whole of Pakistan occupied Kashmir has been homogenised  by the Pakistan government and no hindu, sikh or budhist can be seen in the entire Pakistan occupied Kashmir so much so they carried out this ethnic cleansing in Kashmir valley across the LOC by sponsoring terrorism in the valley.

I would perhaps still agree with you if I could understand the basis of such an opinion. Kashmiri separatist leaders have been asserting all through that they are muslims and would like to be part of a Muslim State called Pakistan or form a separate state with Islam as the state religion. That would mean that we accept the two nation theory once again in the same manner as we accepted in 1947 by default though our leaders have been continuously denying the same notwithstanding the creation of Islamic state of Pakistan. In the event we accept this secession of part of our country what prevents other inimical forces to gain strength and seek independence for states like Tamil Nadu, Punjab, Nagaland, Assam, Mizoram, Manipur, Arunachal and Sikkim.Would this situation be acceptable to you to witness this country get fragmented into small innumerable states just because we could not administer them properly and that people like you and Roy lived in posh glass houses with security given at our nation's expense.

May I further ask you whether Pakistan would also hold such a plebiscite in Sindh, Bulochistan and NWFP? I have not noticed you or Arundhati Roy taking any steps or doing anything substantial to coerce China to hold plebiscite in Tibet or grant independence to them. What action did you take when Sri Lankan Tamils were massacred and butchered by the Sri Lankan Army  recently? You and Arundhati Roy could at least have gone to Colombo, courted arrest and gone on indefinite fast to stop the army of Sri Lanka to conduct such a heinous massacre. But you would not do that because no body would care for you. More so they would have annhilated you in no time. Here in India you can get recognition and big name by speaking such things and posing as pseudo human rights activists and our mass media would give you maximum coverage because they increase their market share by such methods.

I understand your love for human rights and sympathise with you. May I know how many Kashmiri Pandit refugee camps did you visit after their exodus in 1990. How much financial help did you render to them from your personal wealth. How many Kashmiri Pandit refugees did you lodge in your house till they could find some accommodation on their own? If you have not done any of these it does not behove you to talk of human rights and human suffering.

Needless to remind you that USA and European nations, after realising what wrong they had done to the Jews in the past, atoned for it and re-established them in Israel by creating a separate home land for them notwithstanding the opposition from the middle east countries and the whole Islamic bloc. On the contrary, you are keen that Kashmir should secede from India and the Kashmiri Pandits should be deprived of their home land and not allowed to return as also perish in due course of time. I only wish good sense prevails upon you and people like you because parasites grow only at the expense of other's.
